オリコンの行為はインターネットに対する脅威であった。
オリコンは、烏賀陽弘道氏個人に五千万円もの高額名誉毀損訴訟を起こした。個人だけを訴える高額訴訟をためらわなかった。
個人だけを訴えていいならば、次に狙われるのはインターネットである。ブロガーである。インターネットこそ、個人が単独で情報を発信しているメディアであるからである。
だから、私は次のような文章を書いた。
● インターネットはオリコンを倒せるか
インターネットはオリコンを倒せたか。
答は、もちろん「倒せた」である。
オリコンは自ら敗訴を認めざるを得なくなった。「請求の放棄」をせざるを得なくなった。
その大きな要因がインターネット上で厳しい批判を受けたことなのである。
烏賀陽弘道氏は、次のような「高裁協議」の内容を報告している。
黒津裁判官「ＴＢＳの取材がオリコンに入ったそうだ。ネット上でも取り上げられているし、収束したほうがいいという判断にオリコンは傾いている。……〔略〕……」
黒津裁判官「〔オリコンは〕ネット上の批判も強くなってきたので、矛を収めたい」
オリコンは「ネット上の批判」に負けたのである。
詳しく次の文章で論じた。（この文章はメールマガジンで発行した。）
● インターネットを活用した個人が大企業に勝訴
これで、オリコンはブロガーを訴えたら何が起こるかよく分かったはずである。大きな「ネット上の批判」が起こることがよく分かったはずである。
インターネットはオリコンを倒した。
この前例を多くの企業が見ているはずである。
実に素晴らしい前例である。
