その通りである。
「法の趣旨を踏まえ自ら考えて行動」すればいいのである。
どうやら、金融庁には「指示を仰ぐ」問い合わせが殺到して、困っているらしい。（笑）
金融庁は金商法〔金融商品取引法〕の完全施行を目前に控え、金融機関からの問い合わせに追われている。ただ、どうすれば法違反にならないかなど、法解釈にかかわる例が多く、ひっきりなしにかかってくる電話に困惑気味だ。
「顧客セミナーの日程を案内する資料は広告に含まれるか」「投資信託の基準価格の一覧データを顧客に送る際も、リスクの説明を明記する必要があるか」「商品を販売する時に配る資料の冒頭に、何を書かなければいけないか」－－。

金融機関は、自力でものを考えられないのか。
このようなことは、「法の趣旨を踏まえ自ら考えて行動」すればよい。
金融商品取引法の趣旨は〈利点だけを強調しての広告・販売の禁止〉であろう。〈利点を強調する際には、リスク・コストも同程度に強調すること〉であろう。
上の「顧客セミナーの日程を案内する資料は広告に含まれるか」を考えてみよう。これが「広告」かどうかは、どのような「資料」かによる。ただの「日程の案内」ならば、「広告」ではない。だから、特に「リスクの説明」は必要ない。しかし、特定の商品の利点を強調する文言があった場合は、同程度に強調した「リスクの説明」が必要である。
金融機関も、このように自力で法律を解釈すればよい。
金融庁首脳はよいことを言ってくれた。
もう一度、引用しよう。
すべて行政に指示を仰ぐのではなく、法の趣旨を踏まえ自ら考えて行動できないのか
総務省にも、金融庁と同じように腹の太いところを見せてもらいたい。
腹が太ければ、総務省は候補者やブロガーから問い合わせに次のように応えるはずである。
公職選挙法の趣旨を踏まえて、自ら考えて行動してください。
